Jonatan Echebarria Fernández

Associate Professor - Department of Law and Governance

Biography

Jonatan Echebarria Fernández joined the Department of Law and Governance in 2021. He holds a PhD in Law from CBS, where he was employed as PhD Fellow and Research Assistant. He was awarded two LLMs (European Union Law and Shipping Law, respectively) in Spain. He has undertaken PhD courses from the Hague Academy of International Law, the University of the Basque Country, CBS, Lund University, Aarhus University and the University of Southern Denmark. He has pursued specialised courses and certificates from the Lloyd's Maritime Academy, the Cambridge Judge Business School, Columbia University, the College of Europe, the University of the Basque Country, CBS Executive and Harvard University.

Jonatan teaches the following courses at the Bachelor of Business Administration (BBA): International Commercial Law, Marine Insurance, International Maritime Law, Organising the Shipowning Entity and Shipping Management. He is an Honorary Lecturer at The City Law School (City, University of London), where he taught Commercial Law and Contract Law modules at the LLB programme alongside Carriage of Goods by Sea and International Trade Law at the LLM programme. He has previously taught Maritime Law, EU Law, International Commercial Law and International Business Law at the Copenhagen Business School (CBS).
Jonatan's research interests span from Maritime & Commercial disputes and European Conflict of Laws to Environmental Law. He is currently working in some articles and book chapters related to the impact of marine pollution focused on least developed countries’ coastal communities. His PhD-based book titled “Jurisdiction and arbitration agreements in contracts for the carriage of goods by sea – limitations on party autonomy” has been published by Routledge in March 2021. He has delivered presentations at international conferences during the last years.

Jonatan has carried out research activities at the Scandinavian Institute of Maritime Law, the University of the Basque Country, the University of Cambridge, the World Maritime University, the International Maritime Organization, the Ghent Law School, the Max Planck Institute Luxembourg for International, European and Regulatory Procedural Law, the UCD Sutherland School of Law and the University of Southampton. His research has attracted funding from different foundations such as Otto Mønsteds Fond, Professor dr. jur. Sørens mindefond, Reinholdt W. Jorck og Hustrus Fond or Oticon fonden. He was awarded the Basque Government´s Internationalisation grant in 2011 and the Claes Isacson scholarship 2016 handed over by Gard AS.

Jonatan is a Spanish qualified lawyer and he has been registered as a member of the Biscay Bar Association in Spain between 2010 and 2016. His earlier professional experience includes working at the Permanent Representation of Spain to the EU (Shipping Working Party at the Council of the EU), the European Investment Bank, the Trade Office of the Spanish Embassy in Belgium and Luxembourg, the Luxembourg Maritime Administration and the Bilbao Port Authority (Spain).

For the purpose of context this first chapter sets the scene for the book by examining the United Kingdom (UK) and European Union (EU) fishing industries, utilising the best currently available reports and statistical information on the UK fishing industry. It is important to emphasise this data was collected prior to the end of the Brexit transition period, which ended on 31 December 2020. Therefore, this study can only provide an economic “snapshot” to enable a limited forensic projection based on the best currently available information. The first section will outline and summarise the UK fishing industry, while the second section provides a similar breakdown of the EU fishing industry as it pertains to fishing in UK waters. Finally, an outline of the subsequent nine chapters of this book is provided.

Examining fisheries, Brexit, the Trade and Cooperation Agreement (TCA) and its consequences for the Fishing Industry in the UK and the EU, this book explores key issues within the complex topic of fisheries after Brexit. Assessing the new fishing relationship between the UK and the EU, which will continue to develop over the next decade, it provides an important study of the state of fisheries post-Brexit. Taking a cross-cutting economic, legal and policy approach, the book outlines the social and economic impacts of Brexit on the UK and EU fishing industries. It critically analyses the provisions relevant to fisheries in the TCA, reflects on the bilateral fishing negotiations between the EU, UK and Norway, providing inferences as to what the "new and special relationship" might be in fisheries. It then focuses on the 2020 Fisheries Act and explores internal divergences in the nations of the UK because of devolution. Taking an international approach, the work offers an exploration of cooperation in fisheries enforcement, international and regional obligations in marine conservation, and the new horizons for the UK in international fisheries organizations and arrangements now it is no longer a member of the EU. It offers an overview of expert opinion on fisheries post-Brexit, highlighting lessons learned and future developments for fisheries in a post-Brexit world. Having finally signed the Trade and Cooperation Agreement on 31 December 2020 after tense negotiations, the United Kingdom and European Union have found themselves in a new fisheries relationship. This book maps the complex social, economic, legal and policy issues of fisheries in a post-Brexit world and will be of interest to stakeholders and scholars.
